TERMS OF SALE
$10,000.00 non-refundable down on day of Sale in cash, certified check or cashier’s check or check acceptable by the undersigned, with a balance to be paid within 30 days. Bidders must register & submit down payment prior to the beginning of the auction.Time is of the essence. Vessel being sold “AS IS, WHERE IS”. Credit portion to bear interest at the rate of 0% per annum from the date of sale to date of settlement and to be secured to the satisfaction of the undersigned or to pay the full purchase price at the time of sale, at the option of the purchaser. If not settled within 30 days, interest shall be charged at the rate of 15% per annum from the date of sale to the date of settlement. In the event settlement does not occur within 45 day of the sale, the down payment shall be considered forfeited and the property will be resold at the expense and risk of the purchaser. The resale of the property does not limit the seller to further avail themselves of any additional legal or equitable remedies resulting from the failure to consummate the purchase. Time is of the essence. The vessel shall remain at Evans Boats until balance is paid in full. Purchaser of the vessel shall be responsible for the vessel beginning from the moment the vessel is declared sold by the auctioneer regardless of the outstanding or unpaid balance. The buyer is urged to purchase insurance on the vessel immediately after the vessel is declared sold. Secured party shall pay storage for 30 days after sale. Storage Fees after 30 days to be paid by the buyer. All title papers, documentary stamps, recording costs and any and all other costs which shall be deemed necessary to transfer the title of the vessel shall be at the expense of the purchaser. In the event a survey is necessary for the buyer to go to settlement, the cost of this survey shall be at the buyer’s expense and the buyer will be held responsible to go to settlement within the terms and conditions of the sale. The seller will convey good and marketable title. In the event a good & marketable title cannot be delivered, the seller (s) shall have 90 days to correct the flaw. If the flaw is not corrected, the only recourse of the purchaser shall be the return of the down payment and the seller and the auctioneer shall be held harmless. This property is being sold in “AS IS, WHERE IS” condition. The seller (s) may reject any and all bids, however, it is the intent of the seller (s) to sell said property.
